General Sales Conditions

These General Sales Conditions regulate the contractual relations between customers of the www.favero.com site and the company

Definitions
Pursuant to these General Sales Conditions, the following definitions shall apply:

  • SITE: the www.favero.com Internet site through which FAVERO products are sold.
  • CUSTOMER: the party who transmits a purchasing order to FAVERO for products sold through the SITE.
  • CONSUMER: the physical person who makes the purchase for purposes other than conducting commercial, professional, or corporate business.
  • CONTRACT: the distance selling contract between FAVERO and the CUSTOMER, as described and governed by Legislative Decree 185/99.

1. Acceptance of the General Sales Conditions
The CONTRACT shall be understood to have been entered into upon the CUSTOMER's acceptance of the quote and conditions provided by FAVERO. The CUSTOMER who makes the purchase is obliged to print out and/or save this document on a permanent medium.

2. On-line purchasing procedure
A CUSTOMER who wishes to proceed with a purchase must:
  • Place all the desired products in his or her shopping cart and provide the required data as directed by the instructions.
  • Send FAVERO the Request for Quote electronically, by clicking on the appropriate button.
  • Wait for the notification from FAVERO, sent to the e-mail address provided, advising that the Quote is available in the User's Account area.
  • Check that the quote provided by FAVERO corresponds to what was requested and then send FAVERO the purchase order. Payment of the price is understood to signify acceptance of the order.

Although FAVERO reserves the right to refuse the orders it receives-including when this is due to the requested products being out of stock-it undertakes to promptly inform the CUSTOMER in such an event.

3. Payment methods
Only payment types specified in the quotation will be accepted.

  • Cash-on-delivery payments: C.O.D. orders can only be accepted for destinations in Italy. The CUSTOMER shall pay the courrier directly in cash upon delivery of the goods. It is advisable to have the exact amount on hand since the courrier is not obligated to provide change.
  • Advance bank transfer payments: The payment is considered effective only after the amount has been credited to FAVERO's current account. The CUSTOMER must include the order number and the name of the company or person appearing on the invoice.

    The goods will be sent out only after the amount has been credited to our bank.
    The money transfer time may take from 1 to 5 days.
  • Credit card payments:
    We accept MasterCard and Visa credit cards processed on international circuits. At no time are we able to come into knowledge of information regarding your credit card, since it is transmitted via a secured connection directly to the bank that is managing the transaction.
    FAVERO thus declines any responsibility arising from illegitimate or fraudulent credit card use by third-parties.

    Payment via credit card is only allowed if the name and the address of the recipient of the goods corresponds to those of the cardholder.
    Favero reserves the right to ask for a copy of the documents proving the ownership of the card used.
    When a transaction is made on-line, the bank involved only authorises the relative purchase amount. The amount will be effectively charged to the customer's credit card only after delivery of the goods.
    If the order fails to be filled, whether due to Favero's lack of acceptance or to the customer's cancellation, Favero will immediately proceed with the request to release the applied amount.

4. Delivery of the goods
FAVERO shall arrange to send the goods to the address specified by the CUSTOMER at the time the order is placed, by shipping them via trusted international couriers.

Upon receipt of the goods, the CUSTOMER is required to check:

  1. that the number of packages corresponds to the number shown on the shipping document;
  2. that the packages are closed, undamaged, and have not been tampered with or damaged externally.

Failure to immediately report the non-conformity to the carrier, with respect to points 1 and 2 above, before signing for the acceptance of the goods shall bar the CUSTOMER from raising any future objections.

Any problems inherent to the integrity, completeness, or conformity of the products with respect to the order must be reported to FAVERO within 7 (seven) days from the delivery date, by sending a communication electronically to the address favero@favero.com.

Should the CUSTOMER fail to pick up the goods, resulting in their return to sender, the order will be cancelled and the CUSTOMER will be charged for the transport costs, deducted from the previously paid amount.

5. Right of Withdrawal
All FAVERO products sold within the European Community fall under Directive 97/7/EC and the relative Italian transposal legislation on the possibility for non-business customers to withdraw from the purchase contract, with no penalties attached and without having to specify the reason. Such customers may request reimbursement of the amount paid after returning the goods.

FAVERO also extends this withdrawal right to business customers and to products sold outside the European Community, excluding products that have been customised according to customer specifications.

Exercising the Right of Withdrawal

To exercise the Right of Withdrawal, customers must:
  • send a written statement, within 14 days from the date of receipt of the goods, via registered post with acknowledgement of receipt to the following address:

  • wait for FAVERO to set up the process;
  • return the product in its original packaging, undamaged and including all parts, and paying for the shipping costs.
  • FAVERO is not responsible in case of theft, damages, or loss during transport.

Reimbursement of the purchase amount

Once the integrity of the product has been checked, within 15 (fifteeen) working days from the time it is received, FAVERO will arrange for the amount paid to be reimbursed, excluding the transport charges.

In the event that FAVERO finds the product to be lacking any of the aforementioned requisites, the right of withdrawal shall be forfeited.

6. Management of waste of electric and electronic equipment (WEEE)
Please dispose of your product in a manner most compatible with the environment and in accordance with federal or state laws, reusing parts and recycling components and materials when possible.

Administrative sanctions, in accordance with regulations in effect, will be applied for any improper or abusive disposal of the product on part of the holder.

When a user residing in a country of the European Community purchases a new product, he/she has the right to ask for the free collection of an equivalent product (having the same functions)which has to be disposed of. The request for collection must be made at the time of the order of the new product, sending an e-mail to favero@favero.com and indicating the type of device to be collected.

7. Guarantee

All goods sold by FAVERO within the European Community are covered by the legal guarantee, as defined by Directive 99/44/EC and the relative Italian transposal legislation, of 24 (twenty-four) months starting from the date of delivery with respect to any lack of conformity of the goods with their documentation.

FAVERO extends its guarantee to 24 months, under the same terms, to its products sold outside the European Community as well.

Guarantee conditions
The guarantee does not include:

  • parts subject to normal wear-and-tear, such as batteries, connection cords and cables, connectors, moving mechanical parts and exterior surfaces;
  • any software updates, maintenance, periodic checks;
  • damages resulting from carelessness, negligence, any use or installation that does not conform with the instructions provided, and any unauthorised tampering or modifications;
  • damages due to external causes: accidents, infiltration of liquids, fire, voltage surges due to lightning or other sources, etc..

Shipping costs
FAVERO's guarantee does not include shipping costs.

Use of the guarantee
In order to take advantage of the guarantee, the customer must:

  • promptly inform FAVERO of the lack of conformity or defect found in the goods;
  • wait for the relative instructions from FAVERO.

1. Personal data that we collect
"Personal data" refers to any information regarding a person or an organisation that allows them to be identified, even indirectly, such as their name, age, telephone number, postal or e-mail address.

Generally, the data we require includes:

  • your address, including your e-mail address, your first and last names, the legal and trade name of your company or association, the VAT and tax identification numbers, your telephone and fax numbers.  
The IT systems and their related software processes designed to run our website collect some personal data in order to gather anonymous statistics on use of the site and for the purposes of monitoring its proper functioning. These data may permit identification through processing and associations with information held by third-parties. To prevent this from occurring, the data is erased immediately after being processed, remaining no longer than 7 (seven) days, excluding investigation into liability in the event of computer crimes and damages to the site.

We collect, store, and process your personal data for the following purposes:

  • to fulfill our obligations arising from any contract we enter into with customers;
  • to provide our support and assistance when responding to requests;
  • to provide information on our latest products and services;
  • to assess employment applications. 
4. How we collect your personal data
Personal data is collected essentially via computer modules and during electronic communications used to place orders or requests for support; this information may be associated with other information provided on the phone or when visiting our stand at trade shows.

  • To carry out actions on your behalf, such as filling orders, delivering the goods, sending mail or e-mail and processing payments, we will communicate the data to our employees, to third-parties, or to companies who may not, in any case, use them for other purposes and who must process them in conformity with the law.
  • To fulfill any legal obligations we may have. 

8. Security of the data collected
We intend to protect your personal data and maintain its quality by making all reasonable efforts to adopt all appropriate measures, precautions and techniques needed to ensure their security and to protect them from unauthorised or illicit access, processing, changes or destruction. To this end:

  • we restrict access to the data, making them accessible only to employees who are needed to provide the service;
  • we provide you with a password to access your account. 
9. Cookies
Cookies are files that are stored on your computer when you access certain websites. Cookies assist FAVERO in knowing which of its pages are visited most frequently and in recognising your computer the next time you visit the site. This allows you to save time, dispensing with a new registration process every time you want to make a order.
If you do not intend to accept cookies, they may be disabled by following the instructions for your browser. 
10. Options for providing your data
In general, you may visit our website freely and without having to provide any personal data; nevertheless, unless you provide us with your data when filling out request forms, we may not be able to sell you our products, send you informational materials or other communications. 
11. Access to your personal data
You have the right to access your personal data, to update them, to correct or eliminate any inaccuracies and to object to the processing, in whole or in part. To do this, you may contact us by e-mail or telephone, providing us with some identification data in order to ensure privacy. We are responsible, to the best of our abilities, for informing the people to whom the data has been communicated or disseminated and we will provide confirmation of such actions.
In response to your request, you may receive a description of how your personal data are processed.
If you no longer wish to receive e-mails with information on our products, you may exercise your option to cancel in the same e-mail message.

Our website contains links to other sites; although we make every effort to provide links only to sites that adopt high personal data processing standards, we refuse any responsibility relative to the contents, the security, and privacy measures of such sites. 
13. Children's privacy
We do not knowingly collect personal data from children (up to and including 14 years of age) and we do not market our products to children; in the event that we become aware of having obtained any personal data from children, we will immediately erase such data and make every effort to ensure that they cannot be used or divulged to third-parties.

9. Applicable Law and Court of Jurisdiction
The sales contract between the CUSTOMER and FAVERO is deemed to have been entered into in Italy and, thus, is regulated by Italian law, specifically by the provisions set forth in the Civil Code, in Legislative Decree 185/99 on distance contracts, and in Legislative Decree 70/2003 on the execution of electronic contracts, along with their subsequent additions and amendments.
Resolution of any disputes arising from the CONTRACT between FAVERO and the CUSTOMER, with the exception of the provisions for those who make purchases as CONSUMERS, shall be subject to the exclusive jurisdiction of the judicial offices of the Court of Treviso.
